The 4% Club Questions & Answers
20/07 I have just received a written settlement offer from Payright and I have to make a decision in 5 days. Has anyone else received one?
Oh really? I haven’t yet. What did they offer?
They waived the amount owing for the 3 months that I would not receive and I have to finalise paying for the 3 months that I used
I also received a settlement offer with a generous offer (!!) of paying another $640. Yeah, nah. I am disputing the settlement. I've created a FB group so we can discuss how everyone is going with this - search for "4% and PayRight Discussions" if you want to chat with other people in the same boat.
Hi Lindy interested in joining FB Group as I too am with Pay Right. I can't seem to find it under the heading you have given above. Is it still current?
Hey Gail - I am sorry, just saw this. The Facebook group is definitely working and is at external link All welcome!
I joined in April 24 and they must have known at that time that they were in financial trouble. I am unable to access the Jones Partner's Portal for members. Have contacted Jones several times for help with no response. Payright is no better. I missed the part where 'we members' have to keep paying' even though they are now in liquidation - can anyone point me in the right direction to where I can find that info. Has anyone just cancelled their direct debit to Payright? JE
Hi JE, I too am trying to get any kind of information. Pay right are avoiding any kind of explanation but I did manage to get their confirmation of what I suspected. So when we sign up to Payright, they transfer the full amount to 4%. Our debt is now transferred to Payright. So effectively we have to keep our payment going until the debt is payed. How did an online company go bust like this? Once I got into the program I realised how much I overpayed for a program that was mid. The big red flag was trying to speak to anyone at 4%. No one ever answered my calls. Something was very dodgy with the business owners. There is apparently a class action in facebook but I can’t find it. I’m not giving up but bracing myself for the loss of a lot of money.
I am thinking of seeking legal advice (could we be classed as creditors of 4% as they have not delivered 'the product'- have you been able to get onto the Portal (the link Jones Partners gave does not work) JE
I am in the same boat, also thinking of seeking legal advice. I also fell for this scam and have now been made redundant so can't pay the exorbitant fees. I didn't realise that they are now in liquidation, it should be illegal to expect members to continue to pay under those circumstances.
It really sucks and no one wants to talk straight. We are not considered creditors even though it feels like it. Talking to a ‘no win no fee’ lawyer would tell us if we have any hope. They don’t take on cases they can’t win. I have a gut feeling that at the end of the day you can’t get blood out of a stone. Total scam!
Have you been able to contact Payright - I cannot find a phone no for them.
I joined a week before they went into liquidation - should have listened to my gut feeling. Didn’t even get first call after signing. I went to my bank and cancelled the card my direct debit was coming from. Phoned Payright and advised them of this and they were very understanding. When my next payment was due last week I called again and said it wouldn’t be getting paid and the guy said I was not responsible for the debit as the 4 per cent club had the money, not me. He then said they were extending payments due out each fortnight until the matter is resolved. Either way, I won’t be paying a cent more than the first payment they got.
Hi, I canceled my debit card so Payright could no longer take out payments and I had advised them that this was what I was advised to do by my bank. They were very understanding. This created a complaint through Payrights system and they have treated it as such. They have now offered a reduced settlement amount based on the circumstances. I was wondering if anyone had success with a counter offer as their excuse is that most of the program resources are delivered in the first few weeks. I was 4 months in.
I was three months in - it is crazy that they can break down what is 'owed' based on when 4% supposedly delivered services. We would be still paying for services we did not receive. JE
Is anyone accepting the offer made by Payright? Learnt the biggest lesson with the 4% company!
Not sure if we have a choice - a little late to get legal advice now within the 5 days.
I was also 4 months in when I was made redundant and could no longer afford the fees. 4% agreed to let me terminate my contract but as I had been put on a payment plan, I still owe $1000 approximately for the time I have already used. I am simply stunned that an organisation that has gone bankrupt can expect to continue to charge for a service that is no longer provided. I will follow your lead Megan and contact Payright again and request a reduced settlement amount. Worst decision of my life joining this crew.
Yes they are offering a reduced amount as Megan and I advised but that reduced amount owing is still for services NOT provided and I cannot get my head around that. As for most of the services being provided in the first few weeks most programs always give you more time when first starting out and then taper off as you get into the course. I am going to see if I can get legal advice before the deadline. If we do not accept this offer not sure what happens then.
I’m going to write a letter requesting they consider terminating my contract with them based on the simple fact that a service organisation has not fulfilled their obligations. My argument around the resources provided will be along the lines of ‘they were generic resources’ and most are widely available on the web for free. In addition, most were released over the progression of the service and our coaches provided advice on these resources. In some cases they were not relevant to all our needs. I’m also going to advocate that my intentions of joining the program was to loose weight. Continuing to pay and stay on this ridiculous roller coaster will only bring stress and other health and wellbeing issues. I might even mention that even the coaches have reached out up continue the service at half the price, further contributing to the argument that this service was heavily overpriced. It’s the coaches that will benefit from the resources left on the online portal etc. not us! I have a lot more of ‘what I want to say’ stored in my head. I’m just going to see how it goes. My greatest fear now is loosing my credit rating if they pursue the matter further.
I am starting to think I might pay their reduced offer. Cannot get to a legal person within the 5 business days to accept their offer.
I have sought legal advice and it is good news only paying for the time I used.
My solicitor advised that we only have to pay for the time we used it and Payright are fine with that. I have already settled.
