Questions & Answers
Is it right to deny someone employment for something they may have done 20, 30 or 40 years ago?. People change and we should not hold a gun to someone's head for life because of their past. How are people supposed to move on and start again in life when a mistake can basically exclude them from employment for life and not be able to move on. Police checks have gone too far in Australia where it doesn't matter how long ago your one mistake in life was, 1 strike and your out. Before 2011 employers were only able to look back 10 years on a persons history. Now you make 1 mistake and even if it's decades back and you've been clean since, you won't get a job. We're supposed to be a country of giving second chances in life. How is that so when employers are allowed access to every part of your life from a young age. Wrong on so many levels. Am I allowed to do a police check on my prospective employer to check if they are a flawless human?.
Good Morning William, thank you for your question. There is spent convictions legislation in each Australian state and territory, which means minor or less serious offences generally do not show up on... Read morea police check after a certain period of time has lapsed (depending on the purpose stipulated on the check). Please refer to the spent convictions legislation of your state or territory for more information on this. Furthermore, offences on nationally coordinated criminal history checks are released based on the purpose of the check and the information release policies of Australian police agencies. This means the purpose stated on the check needs to accurately describe the activity being undertaken by the applicant, as it may impact the disclosable court outcomes that are released on a check (if any). Thank you for the reply. My point is Governments should not be allowing organisations to look back decades into a person's past not allowing them to move on with their lives and start again, especiall... Read morey in the case of older people. If someone has been clean for say 20 years and has a good work history, it's got the the stage where that person will be highly unlikely to find work such is the obsession these days from employers to find "flawless humans" to fill the job roll. Now even with spent convictions, certain industries, for example driving a taxi, even spent convictions from say 30 years ago are still available for them to view. Why is even a serious offence dating back 30 years that's spent allowed to be seen by any employer. It doesn't matter if you've been 100% trouble free in that 30 years, you will not be employed in certain industries, that's madness and laws need to be changed. We now watch every step people take throughout their entire lives and my view is in the past 20 years, police checks regarding employment have gone way too far.
Has anyone got a direct phone number, I cant get past the section where they take the money from my credit card and you are required to continue the application. I have sent an email, a week ago, but no reply.
