your company at my residence and the misrepresentations made during the sales process. As per the laws and regulations of the State of Victoria, Australia, specifically the Australian Consumer Law (ACL) and the Fair Trading Act 1999 (Vic), I must formally outline the issues I have encountered with your services and request an appropriate remedy.
I have opened a case with Consumer Affairs, who advised me to email you this letter.
Upon engaging your services, I was assured that the solar system installed at my home would be efficient, significantly reduce my electricity bills, and qualify for government subsidies. Regrettably, none of these assurances have come to fruition.
Firstly, despite your confirmation that the solar system would suit my house and result in noticeable electricity savings, I have observed no discernible decrease in my utility bills. In fact, when factoring in the instalment payments, I am paying more than before the installation in non-summer months.
Moreover, your representation that the solar system would eliminate my electricity bills during the summer months has also proven false. I am still paying a considerable amount (around $40). The Humm complaints representative also advised me that Energy control repeated the same to him.
Additionally, I must address the issue of the converter's sun cover melting, which poses a safety hazard and highlights the substandard quality of the equipment provided. Your company misrepresented the warranties and the fitness for the purpose of the system, which clearly violates consumer protection regulations, particularly Section 18 of the Australian Consumer Law (ACL).
Furthermore, it has come to my attention that the number of panels installed was grossly misrepresented. Upon my complaint, your representative insisted that 16 panels had been installed, yet only six were installed upon completion. I demand an explanation of this statement.
It is worth mentioning that before engaging your services, I communicated to you that I consulted another solar system provider who advised against installation because of insufficient roof space. However, you assured me that your system would overcome this limitation, which has clearly not been the case.
In light of the aforementioned issues, I have no choice but to request a full refund of the amount paid for the solar system or for your company to rectify the system so that it performs as promised and generates enough electricity to yield savings. Additionally, I demand clarification regarding the absence of government subsidies promised during the sales process.
Please promptly acknowledge receipt of this letter and provide a detailed plan of action to address these grievances within a reasonable timeframe. Failure to do so may result in further action being taken to seek redress through appropriate channels.
I expect your prompt attention to this matter and a satisfactory resolution.
