Bullies – We have been chasing these guys through the Fair Trading and now NCAT for quite some time, only to hear they have gone into liquidation. I encourage everyone who has had problems with this company to follow their progress and make sure they don't pop up again under another name and continue trading, deceiving more unsuspecting consumers. I have noticed that their website is still running so imagine they are still functioning, albeit covertly.

Resort Pools in Liquidation – I have just been notified Resort Pools and Spas has gone into liquidation. I had only paid my deposit and home owners warranty so extremely thankful that's all I paid. I have phoned fair trading and was advised we can try and get money back through HOW. I have now got a pool company in Blaxland coming out to quote me.

They took my pool shell after i paid – Resort pool delivered the pool shell and place it in the land next to my land as they suppose to dig the hole in one week, then it took 3 months promising by the liar Mal Scott then he stops answering or replying, then after the new year i discover that the pool shell is not there anymore and the company numbers are not connected!! any advise from you guys about what will happen after lodging a complaint with fair trading?

Like most of you, we're just waiting for Malcolm Scott to do the right thing and file for liquidation so we can access our insurance. Then we can get our pool finished promptly and properly.

The worst part of this debacle is that our building company, Eden Brae, forced us to use Resort Pools. Apparently Resort Pools were the only pool company that was covered by Eden Brae's insurance policy. We would not have chosen Resort Pools if we had the choice.

Don't get your pool built with Resort – Signed contract 2012 before house was built. Said they worked with building companies to do pools during construction of house but this ended up not being the case. Mal Scott. No complaints re trades persons up until tiler. Says a lot about a company when you have a site meeting and they lie to your face even though you have cameras to prove otherwise. Tiler didn't lay the tiles, the labourer cut and laid which ended up with job being unsatisfactory. promised to fix works but we are still waiting. Contacted fair trading but in the end Mal Scott would not return their calls either. Hopefully he will go bankrupt so then we can go through Home Builders Warranty to get works rectified. It has been a bad experience and we should have went with the company that built our first pool - Award Pools. Mal can talk the talk which got us to sign contract, but is unable to deliver.

Taken for a ride – I’ve organised plans and approvals myself last year. The owner of the company well-articulated MALCOLM SCOTT gave me a favour of talking to me twice in 6 month with very enthusiastic and shameless lip service updates. Their supervisor by the name of MATT doesn't show any interest in completing the job and has some more important things to look into.

Before Christmas I got a rectification order from department of Fair Trading. Still waiting to hear from Resort Pools. At this moment I’d be happy if they returned some of my money so I can get somebody interested to finish.

took 6 months, and countless phone calls and emails. Resort's fencing sub-contractor contacted us to ask if our fencing had been inspected and a compliance certificate issued (it had), because Resort were not paying him until the inspection had been done - right away I suspected a cash flow issue for resort. Then Resort kept giving us lame excuses as to why the solar heating was delayed - so I phoned the solar heating company myself and they said they had been waiting for Resort to book the installation in. In the end I suggested to Resort that they take the solar heating off the contract and I'd arrange it myself - lucky for us they agreed. At the time I wondered how much longer Resort would be in business, and based on all your bad experiences I'm amazed they still are in business! Good luck to any of you who are still chasing Resort for completion of your pool build or are chasing them for money through Fair Trading or legal action. I'll be watching this page with interest!

committed in writing to finishing the pool on the 6th September, it is now almost December and it seems unlikely they will finish this year. They simply ignore my emails, calls and text messages, and now they are even ignoring a letter from my solicitor to provide a new schedule for completion, and a revised penalty agreement. All we get are lame excuses, and “we will definitely be there tomorrow”, and tomorrow…..well tomorrow never comes.”

I believe this company is acting in a way that shows a total disregard for the legal contract they entered into, they have my money and I am helpless. It seems like they don’t really care if they never complete the job. The crazy thing is Resort Pools and Spas could string us out for another 10 month and the total penalty would $500.00 on a total contract price of over $70,000. This is simple not fair.

It was a disaster right from the start, at every step there have been unexplained delays, covered by excuse after lame excuse. It took nearly three months to get consenting development approval, a process the Ku Ring Gai Council say on their website takes a few weeks.

We received the consenting development approval on the 4th June, but for another 2 months nothing happened. With calls going unanswered I believed the company might be in some kind of financial difficult, so I requested assurance that the company was still able to honour the contract. That was ignored. I also asked for a new schedule of completing and received a plan that committed them to complete the pool in 12 weeks after excavation. It is now week 18 after excavation.

Finally the excavation began on 18th July, formwork the follow week and they concrete shell was completed on 12th Aug. On the day of the concreting, the Resort Pools and Spas construction supervisor showed up for a short while, and took off in his high-power HSV like a hoon before the concreting was completed. When the formwork man returned he hit the roof to find that part of the formwork that should have been removed during the concreting had not be removed, and as a result the formwork wood was now concreted into the pool wall. This was a huge problem, because it left several holes that would leak when the wood eventually rotted away.

They were supposed to resume work on the pool on the 8th September. Call after call, excuse after lame excuse. Every week they would promise the finishing supervisor will be there on Monday, no Friday, no he is delayed on another job, so Wednesday. On the 3rd November at about 11am two guys in a Resort Pools and Spas ute turned up. They asked where the nearest Bunnings was, and disappeared for over an hour, came back with a couple of bags of cement. A couple of hours later, off they went for another hour and can back with an extra bag of cement. They appear to have tried to fill the holes left by the formwork. I did not see if they cleared the wood, or just covered up the hole. I suspect this was quick fix, and it will probably leak.

On Tuesday this week (18th November) a tiler turned up. The Resort Pools and Spas finishing supervisor turn up an hour later and after lots of wandering around in circles, I get a knock on the door. The supervisor tells me the tiler has a back problem and needs to go the physio, and off they both disappear. I get a call later from the supervisor to say that the tiler would probably not be back, and he would get another tiler who might be able to fit us in between jobs. He would bring him around today. It is tonight, and nobody turned up. They also said the pool pump and filter equipment would go in this week, and all the plumbing would be hooked up. Not going to happen.

I had the shell inspected by an engineer today. Major problems. The pool walls are too low, and it is going to be a problem getting the edge up to the agreed level, which means that my deck is going the be higher than the edge of the pool. Big problem, and probably the reason the tiler’s back was suddenly a desperate need of a physio.

We are now 6 weeks over their agreed completion date. No tiler, plumber. I am told there is no way we will get a team to complete the interior rendering this side of Christmas.

I have tried everything possible to get work completed. Solicitors letter, threats of going to the media, Fair Trading and ACCC complaints. Resort Pools and Spas are fearless; they operate above normal business perimeters. Nothing seems to worry then, and we are left hopeless.

And we are not alone. A group of disappointed Resort Pools and Spas clients are getting a damages class action case together, to make Resort Pools and Spas accountable for their actions. If you are having the same problem please contact me. john dot gerrie at bigpond dot com.

I am ready to lock Resort Pools and Spas out, and get the pool done with another company, and recover the cost from Resort Pools and Spas in court.

I already have two pool finishing / renovating companies quoting on completing the pool.

Downhill after concrete shell is poured – Everything went smoothly until after the concrete shell is poured. Looking at the balance sheet, that's about 80% done. the balance than to let us wait indefinitely. I have no problems with forfeiting a portion of the deposit (~20%) just to progress it with someone else. The lack of update, lack of reply when called even though messages are left, lack of knowledge on when things can happen is just crazy.

I believe running a company is hard job. However, as with any company, you need to sort our the mess and be up front with customers on what is happening, and why things cannot happen. Nobody likes to wait indefinitely without a timeline or update. If someone from the company read this message, put yourself in our shoes. Most of us just want an update and a "reasonable" timeline on when things can be done. A pool taking longer than a house to build? Really?

Disgraceful – Phone calls not returned. Repeated requests for dates and times of expected completion are being ignored. 6 weeks of phone calls and emails just to get them to cover the pool. date and now we have 4 days and the site supervisor still can't find a tiler to finish the coping. Rather than completing other work, all work has stopped. When we call no-one picks up. We leave messages, send texts and no-one responds. When I do get a response, it is an excuse as to why things are out of their control. They are complete "victims". We even sent a contact to them so they could organise pool coping. They ignored our message and guess what... still no pool coping.

We have tried working with them, being pushy, threatened to go to the dept of fair trading... It makes no difference. Our experience with this company has been nothing but stressful and frustrating.

Next step for us is fair trading and then arbitration.

Terribly Disappointing! – Salesperson was fantastic, sold me the pool and made me feel comfortable but unfortunately from thereon I was terribly disappointed. Almost 2 years on and I am still waiting to have my pool finished. Management does not return calls or seems to take any responsibility. I just don't understand how they are still in business. Save yourself the heartache and disappointment, go somewhere else!

promised to come and fix it (and pick up the trailer load of rubbish they left behind). Now I'm engaging fair trading.

Don't waste you time with this company, they have expert sales people but thats about it. Very disappointed with the result.

Expensive, bad design, slow build, used cheap parts not rated for the size of pool.

often outsourced to "tradespeople" who clearly were not competent. Work was eventually rectified but I had to point out defects which should have been the supervisors role. I regularly arranged meetings on site, often taking time off work and they didn't show, no phone calls or explanations. The boss of the business takes no responsibility - I tried on several occasions to speak with him - strangely he was always "in a meeting". Must have been a long meeting as he never called back despite promises he would. They clearly take on more work than they are able to cope with and who pays - the client. My advise - look elsewhere. All progress payments made on time by me. When I suggested the final payment be delayed by the same delay of their work I was threatened with being taken to court - what a shambles this company is. Run away - Fast! Price was competitive Poor workmanship, no communication, continual delays, completely disorganised. Management takes zero responsibility.

Resort Pools - Terrible – We are extremely dissatisfied with Resort Pools who we are using to build our concrete swimming pool. We are sharing our experience as a warning to other people who may consider using this company. We signed a contract with resort pools in March 2012 roughly the same time we signed a contract with a project builder to construct our new home.… Read more

This meant our pool had to be constructed in two stages.

First stage saw the excavation of the site, the laying of the formwork and pouring of the concrete pool shell in July 2012. I can say this first stage went pretty well and we were happy with the result.

When our new house was finished in March 2013 and hand over was completed, we advised Resort pools so they could come back onto the site and complete the second stage from April 2013. This is where everything began to go downhill and the problems commenced.

Some of the many problems we have encountered include the following:

• When our pool coping and paving round the pool was completed in June 2013, Resort Pools were advised to come and finish the pool. However since then, the pool remains unfinished and we are now at the end of January 2014. Overall it is now 7 months and we are still waiting for the pool to be finished.

• There were unexplained delays in getting the pool tiler to complete their work, which took approximately 6 weeks.

• The pool lining was completed in Sept 2013, but the filter was not connected and no equipment provided, resulting in the pool lining becoming stained.

• In Nov 2013 Resort came back, cleaned the lining and advised they would come back another time complete the remaining items and get the pool ready for final handover. We did had a issue with the pool lining being stained again (that was outside of Resort Pools control), but we advised them we would rectify that ourselves and requested final completion of items and formal handover. This has not yet occurred.

• During this time there were demands for progress payment to be paid despite the work clearly not being completed as per the contract.

• We were allocated a site supervisor that never answers their phone, never returns phone calls or very rarely returns SMS’s.

• We were contacted by office staff and were verbally advised the pool would be definitely finished by Christmas 2013. Yet no one has come to complete the pool and no one from Resort Pools has followed up to see if the work has been done.

• Under the terms of the contact, Resort pools have 10 weeks to complete the pool. This is one of the points they use during the sales process before you sign. However if there are circumstances outside the control of Resort Pools, they are allowed to extend the 10 week period. However Resort Pools must provide written confirmation to the property owner on the time frame it will take to complete the pool. We have requested this written confirmation from Resort Pools on three separate occasions however they have failed to provide any formal response. ( despite being contractually obliged to do so)

It appears nobody from Resort Pools is managing to pool construction process, there is definitely no follow up and the company has not worked within contracted time frames or not keep promises made when the contract was signed.

We are more than frustrated with using this company and if we were ever to build a pool again, we would definitely NOT use Resort Pools again. If you wanted our recommendation on Resort Pools, we unfortunately would not recommend them.

As of the end of January 2014, we are still waiting for Resort to come and finish the pool.

NOTE: as at Friday 7th March 2014 - the pool is now finished. Resort Pools came back in early March 2014 and completed all remaining tasks and handover was completed . Couple of small jobs outstanding but most of the pool is now finished. Product was well priced, Sale rep. was great to deal with. Bad service, no follow up, no management of the pool building process
