Astonishing incompetence
VBCS and particularly [Name Removed] have once again proved their incompetence. Our building is literally rotting around us and works planned years ago have still not been done. We have leaks, breaking cement, the facade of the building is literally falling off in large chunks, the railings are rusted, the window frames rotting, we have both cockroach and rat infestations, and due to the windows the cockroaches can stroll right in. I accidentally paid both OC 1 and OC 3 fees into the OC 3 fees and received an overdue notice for my OC 1 fees. Congratulations for a massive turn around.
From a sustained level of deep frustration necessitating consideration of alternative OC managers only a few months ago, to a level of service I cannot fault.
Rodrigo is responsive, wise in his dealings with people and issues, caring of the matters that are raised and the information and guidance that is sought. The senior mangers with whom he consults and Maddison in support enable confident and timely assistance whilst the team now having a focussed understanding of low density buildings eliminates the frustration of recieving irrelevant, no-sense advice.
Congratulations to all levels of management for a massive turn around. The only thing I ask for now, is for continuity.

Received a overdue levy notice from Simone - genuinely overlooked paying it. Simeone was very courteous and not pushy which goes a long way in situations like this, where I was kicking myself for forgetting. An absolute asset to the company! Don't let her leave.

How do we change the Manager of our OC? We have been with VBCS since incorporation. Would prefer to stay with VBCS but the current Manager has never been on site and is therefore difficult to work with.

Why is our OC not permitted to have our AGM at an agreed location rather than by a teleconference?
We are thinking seriously to terminate our present Body Corporate Manager. Please advise what's the procedure according to the latest Owners Corporation Act 2021? We do have a Committee formed as our apartment only has 14 units.
Terminating your Manager is covered under the Owners Corporation Act 2006 Part 6 Section 119 allows an OC to appoint a manager and revoke an appointment. As the form of resolution is not specified, it is an ordinary resolution pursuant to section 92. If the appointment of a manager is terminated the manager is required to return the records and funds to the Secretary of the Owners Corporation within 28 days of termination - Section 127.
As is an ordinary resolution the power may be delegated to the committee. If in delegating powers to the committee, which is done when the committee is appointed at the AGM, the power to appoint or terminate a manager has not been delegated, the Committee does not have the power in which case the power may only be exercised at a general meeting of members. This requires consideration of the delegations made when the committee was appointed. It may have been recorded in the minutes of the meeting or alternatively a separate Instrument of Delegation may have been executed. These need to be reviewed.
If no delegations were made to the committee, pursuant to section 11(5) of the OC Act, the committee has all of the powers which may be exercised by a resolution other than those reserved for a general meeting (the section 82 fetter). Thus it could appoint the manger. If the minutes appoint a committee do not record any delegation then section 11(5) operates.
If the OC has passed an ordinary resolution at a general meeting requiring the appointment of termination of a manager may only be determined at a general meeting, the Committee does not have that power (section 82). If that resolution was passed previously it continues until revoked. This is contrasted with the delegation to the committee which is active only for that committee and expires when a new committee is elected. It can of course be refreshed, and usually is, when the committee is appointed.
