So many complaints about this fridge, faulty from the start – Samsung French Door fridge, main comaprtment and ice maker always icing up. Constantly having to defrost and unstick the ice drawer. This is a known fault from Samsung since 2015. We bought the fridge in 2016. Eight years old and they still sent their technician, free of charge, to confirm the problem. He took pictures and left saying it is unrepairable. Woolley Appliances, seems to be the company they send out and everyone gets the same response. Can't be fixed. The point is that this fridge was sold with known faults and we the consumer were never warned. An average lifetime of a fridge should be 10-20 years. This one, like thousands out there, didn't make it past 8 years
Purchased in at The Good Guys for $2,721.
- Household Size: 4 person(s)
Hello, the issue still exists. My fridge of 8 years is constantly freezing food. And the ice maker is constantly freezing up. This is a known issue since 2015.
I quote section 54 and Section 58 of Australian Contract Law; Section 54 of the Australian Consumer Law sets out the guarantee that goods supplied in trade and commerce (except for when bought at auction) will be of acceptable quality.
When looking at whether goods are of acceptable quality, section 54(2) of the ACL sets out the qualities which are required. These are: 1. The goods are fit for all the purposes for which the goods of that kind are commonly supplied; 1. The goods are acceptable in appearance and finish; 1. The goods are free from defects; 1. The goods are safe; and 1. The goods are durable. For goods to be of acceptable quality, all of these qualities must be present. If one quality is missing, then the goods will fail to meet the consumer guarantee (Vautin v By Winddown Inc – formerly Bertram Yachts) (No 04) [2018] FCA 426).
In this case, the goods were not free from defects and are not durable. There are literally thousands of similar complaints about this refrigerator.
Section. 58 of the Australian Consumer Law requires manufacturers to take “reasonable action” to provide spare parts and repair facilities for goods supplied to consumers for a “reasonable period” after purchase.
In this case, W@#$% Appliances, is sent out, each time, knowing that the known fault is unrepairable.
A fridge, especially a high end fridge like this one, should last 10-15 years, many websites support this. This fridge didn’t make it to 8 years with all its hidden problems.
Good afternoon Jim, Thank you for providing these details. I have reviewed your case, and can see this has been through our Voice Of Customer team. They have considered all factors and concluded that Samsung is unable to offer a free of charge remedy.
I completely understand this isn't the outcome you're seeking, but unfortunately it is far outside of our warranty period.
Kind Regards,
Brian Samsung AU
Jim just now Hello Brian, this has nothing to do with your warranty period. Samsung, in this case, have breached Sections 54 and 58 of the Australian Consumer Law. The Goods were not free from defects, when sold. The Goods are not repairable, even after a a reasonable period after purchase. You send Wooleys Appliances out, knowing full well, it can not be fixed.
The ACCC agrees below. ACCC Response (Reference: REF4512239) [SEC=OFFICIAL] Your rights: acceptable quality Products you buy from businesses should be reasonably:
acceptable in appearance and finish free from defects safe durable able to do what products of their kind normally do.
If a product you buy is not one of these things, it does not meet the consumer guarantee of acceptable quality and you are entitled to have the problem fixed.
The guarantee of acceptable quality takes into account what would normally be expected for the type of product and cost.
Repair, replacement or refund – faulty product You have the right to ask for a repair, replacement or refund if a product fails to meet a consumer guarantee.
Therefore, "Samsung is unable to offer a free of charge remedy" , is not my problem, but yours. Try again.
I require the old, faulty fridge to be removed and a full refund as soon as possible.
Samsung selling faulty fridges for years and not taking any responsibility.
How long should a high end, big brand refrigerator last?
I. Coverage and Application A. Samsung Electronics Australia Pty Ltd of 3 Murray Rose Avenue, Homebush Bay NSW Australia 2127 ("Samsung") warrants that your Samsung consumer product:
•is of acceptable quality;
•does not have a latent defect.
Samsung, has broken their own warranty, it does and did have a latent defect when sold.
So, will @Samsung admit, on record, that their refrigerators won't last 8 years?

This company just ignores you, once they take your money, no after sales service at all. Shameful company.
